Welcome to Texas Hill Country Olive Co. ("Texas Hill Country Olive Co.," "THCO," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, products, services, memberships, subscriptions, events, and related offerings.
By accessing our website, creating an account, placing an order, enrolling in a membership or subscription program, attending an event, or otherwise using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our website or services.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to make purchases through our website.
By using our website, you represent and warrant that you have the legal authority to enter into these Terms.
2. Products and Services
Texas Hill Country Olive Co. offers olive oils, balsamic vinegars, specialty foods, gifts, experiences, events, memberships, subscriptions, and related products and services.
We reserve the right to modify, discontinue, limit, or refuse any product, service, promotion, event, membership, subscription, or offering at any time without prior notice.
3. Pricing, Availability, and Order Acceptance
All prices are displayed in U.S. Dollars unless otherwise stated.
Prices, promotions, discounts, and product availability may change without notice.
Submission of an order does not constitute acceptance of that order.
We reserve the right to refuse, cancel, limit, or modify any order for any reason, including:
- Product unavailability
- Inventory discrepancies
- Pricing errors
- Promotional errors
- Coupon misuse
- Suspected fraud
- Payment processing issues
- Technical errors
Product availability is not guaranteed until shipment confirmation has been issued.
If we cancel an order after payment has been received, our sole obligation will be to issue a refund of the amount paid.
Accuracy of Product Information and Pricing. We make reasonable efforts to ensure that product descriptions, tasting notes, ingredient lists, images, specifications, availability, and pricing displayed on our website are accurate. However, we do not warrant that such information is complete, current, reliable, or error-free. In the event of a pricing error, typographical error, product description error, or inventory error — whether on our website, in promotional materials, in confirmation emails, or elsewhere — we reserve the right to cancel or refuse to fulfill any affected order at any time prior to shipment, even after order confirmation has been issued. If payment has already been processed for a canceled order, our sole obligation is to issue a refund of the amount paid.
4. Subscription Programs, Recurring Charges, and Auto-Renewal
Participation in any subscription, recurring order, membership, or auto-renewal program (collectively, "Subscription Programs") is governed by the applicable program terms in addition to these Terms. Subscription Programs may include:
- Olive Oil Club
- Subscribe & Save
- Gift Memberships
- Future membership or subscription offerings
The Olive Oil Club Terms & Conditions and Subscribe & Save Terms & Conditions are incorporated herein by reference.
Recurring Billing Authorization. By enrolling in a Subscription Program, you expressly acknowledge, authorize, and agree to the following:
- You are signing up for a recurring subscription that will automatically renew and bill the payment method on file at the frequency disclosed at the time of enrollment (e.g., monthly, bi-monthly, quarterly) until you cancel.
- You authorize Texas Hill Country Olive Co. and our payment processors to automatically charge your payment method on file for each recurring shipment or billing cycle, including the product price, applicable taxes, shipping fees, and any other charges disclosed at enrollment.
- Subscription pricing, product selection, billing frequency, and shipping cadence are disclosed on the product or enrollment page at the time you sign up.
- We may change subscription pricing, product offerings, or program terms from time to time. We will provide notice of any material change in advance of the next billing cycle, and your continued enrollment after the effective date constitutes acceptance.
- Charges will continue to recur until you cancel in accordance with the cancellation procedures below.
How to Cancel. You may cancel any Subscription Program at any time, for any reason, through any of the following methods:
- Online (self-service): Log into your account on our website and manage or cancel your subscription directly from your account dashboard.

Cancellation will take effect prior to the next billing cycle, provided that the cancellation request is received and processed before that billing cycle begins. Charges already processed for orders in production or in transit are not refundable as a result of cancellation, except as required by law or our Return & Refund Policy.
Gift Subscriptions. Gift subscriptions do not automatically renew unless the recipient or purchaser separately enrolls in a recurring program.
California Subscribers. California subscribers may cancel a subscription at any time using the methods described above, in accordance with California Business and Professions Code §§ 17600 et seq. (the California Automatic Renewal Law).
5. Shipping and Risk of Loss
Shipping and delivery are subject to our Shipping Policy.
Title and Risk of Loss. All purchases are made pursuant to a shipment contract. This means that title to the products and the risk of loss or damage pass to the customer at the time we deliver the products to the shipping carrier (including, without limitation, USPS, UPS, FedEx, or any other common carrier). Once the products are tendered to the carrier, the customer bears all risk of loss, theft, damage, delay, or destruction.
Customers are encouraged to purchase any available shipping insurance or protection at checkout. Claims for lost, stolen, or damaged shipments must be filed in accordance with our Shipping Policy.
Delivery dates are estimates only and are not guaranteed.
Texas Hill Country Olive Co. is not responsible for delays caused by:
- Shipping carriers
- Weather events
- Natural disasters
- Labor shortages
- Supply chain disruptions
- Government actions
- Events beyond our reasonable control
Customers are responsible for providing accurate shipping information.
Texas Hill Country Olive Co. is not responsible for shipments delayed, lost, returned, or misdirected due to inaccurate customer information.
We are not responsible for product quality issues resulting from packages left unattended after delivery or exposed to excessive heat, freezing temperatures, or other environmental conditions.
6. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy.
Except where required by law, products are not eligible for return, exchange, or refund once used, consumed, opened, damaged by customer handling, or otherwise rendered unsuitable for resale.
Approved refunds may be issued as:
- Original payment refunds
- Store credit
- Product replacements
- Alternative remedies at our discretion
7. Food Product Disclaimers
Product descriptions, tasting notes, recipes, serving suggestions, nutritional information, and educational materials are provided for informational purposes only.
Individual taste preferences vary.
Dissatisfaction based solely on personal taste preference does not constitute a product defect.
Allergen Disclosure and Customer Responsibility. Our products may contain or come into contact with common allergens, including but not limited to tree nuts, peanuts, milk, eggs, soy, wheat, sesame, fish, and shellfish. Products may be manufactured, packaged, stored, or handled in facilities that also process these allergens. Texas Hill Country Olive Co. cannot guarantee that any product is free from allergen cross-contact.
It is the sole responsibility of the customer (and any person to whom the customer gives, serves, or resells our products) to carefully review the ingredient list, allergen statements, and product labels for every product prior to purchase, consumption, or service. Customers with known or suspected food allergies, intolerances, sensitivities, or dietary restrictions should consult a qualified healthcare professional before consuming our products.
To the fullest extent permitted by law, Texas Hill Country Olive Co. shall not be liable for any allergic reaction, adverse health effect, illness, injury, or damage of any kind resulting from the consumption of, contact with, or exposure to our products.
8. Health and Nutritional Information Disclaimer
Statements regarding nutritional, wellness, dietary, or health-related benefits have not been evaluated by the U.S. Food and Drug Administration unless expressly stated.
Our products and content are not intended to diagnose, treat, cure, or prevent any disease.
Customers should consult qualified healthcare professionals regarding medical, dietary, or nutritional concerns.

All content available through the website is owned by or licensed to Texas Hill Country Olive Co., including:

10. User Content and Reviews

TO THE FULLEST EXTENT PERMITTED BY LAW, TEXAS HILL COUNTRY OLIVE CO.'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCT, SERVICE, MEMBERSHIP, OR ORDER GIVING RISE TO THE CLAIM.
UNDER NO CIRCUMSTANCES SHALL TEXAS HILL COUNTRY OLIVE CO. BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
18. Indemnification
You agree to defend, indemnify, and hold harmless Texas Hill Country Olive Co., its owners, employees, affiliates, suppliers, and representatives from any claims, liabilities, damages, costs, or expenses arising from:

The arbitration shall take place in Texas.
The parties waive the right to a jury trial.

You agree not to participate in any class action, collective action, consolidated action, or representative proceeding against Texas Hill Country Olive Co.

These Terms shall be governed by the laws of the State of Texas without regard to conflict-of-law principles.

Texas Hill Country Olive Co. shall not be liable for delays, interruptions, failures, shortages, cancellations, or inability to perform caused by circumstances beyond our reasonable control, including:
